Seeking Advice on a Gainsco Situation

Hi everyone,

I’m in a bit of a bind and could really use some guidance. I was involved in an accident at the end of February here in Pennsylvania. The other driver made an illegal u-turn in the middle of the road, and I didn’t have enough time to stop, resulting in the collision. It’s clear the other driver is at fault, and I followed all the standard procedures after the accident.

However, I’ve been getting the runaround with Gainsco, the other driver’s insurance company. It seems the driver has gone completely unresponsive, leaving me in a tough spot. Gainsco has informed me that since he holds a low-tier policy and hasn’t completed two full terms, his coverage is void, which means they won’t cover any damages to my vehicle. I understand that they are based in Florida, but this situation seems illogical. Despite explaining the circumstances, they insist that unless the driver communicates with them and provides verification (possibly suggesting he used fraudulent documents to get the insurance), I’m out of luck.
