No statement

I was recently involved in an accident, and both the police and my insurance have confirmed that I was clearly not at fault. I’ve been cooperative with both my own insurance and the other party’s insurance. However, it’s been over a week and a half, and their insurance still hasn’t received a statement from the other driver. Is this typical? Are there any laws that require people to provide statements?

  1. It sounds like a frustrating situation. Generally, it’s not uncommon for the claims process to take some time, especially if the other party is dragging their feet in providing a statement. Insurance companies typically need this information to assess liability and process claims effectively.

While there aren’t specific laws preventing someone from not giving a statement, it can delay the process and may lead to complications. Most insurers encourage cooperation, and in many cases, they have a certain timeframe in which they expect to contact all parties involved. If the other party continues to be unresponsive, their insurance may eventually have to make a decision based on the information available—including police reports and witness statements if there are any.

In the meantime, keep following up with your insurance company for updates and make sure they know you’re keen on resolving the claim as soon as possible. If you feel things are dragging on too long, you might also consider asking your insurance if there’s anything else you can do to expedite the process.
