Someone rear ended me and denied liability

I was rear-ended last week, and now the driver is denying responsibility. After the incident, he gave me his insurance information, and we both spoke with my insurance company, deciding to file a claim with his provider (State Farm). During our call, we discussed the damages to both vehicles.

However, earlier this week, State Farm reached out to say that the driver had denied any contact between our cars and that they are looking into the matter. I have photos of my vehicle’s damage, as well as pictures of his insurance details and his ID that I took at the scene. What should I do next? It feels ridiculous because if there was truly no contact, why would he provide me with his insurance info and let me take a photo of his ID?

To make matters worse, his car shows no damage since he has a metal front bumper, while my rear bumper is cracked.

  1. I’m sorry to hear about your situation; that sounds frustrating. Here are some steps you can take to strengthen your case:

    1. Document Everything: Keep all evidence related to the incident, including photographs of the damage to your car, any pictures taken at the scene, the exchanged information, and any communication with both insurance companies.

    2. Witnesses: If there were any witnesses to the accident, gather their contact information and statements. Witness accounts can be crucial in establishing liability.

    3. Report to the Police: If you haven’t already, file a police report if it’s possible to do so. This can serve as an official record of the incident and may help with your claim.

    4. Contact Your Insurance: Keep your insurance company updated on the developments, especially since the other party is denying contact. They may be able to advocate for you or help gather more information.

    5. Consider a Claim Against His Insurance: If his insurance is investigating, ensure you follow up with them and provide any evidence you have to support your side of the story.

    6. Consult with a Lawyer: If the situation doesn’t resolve easily, consider consulting an attorney who specializes in auto accidents. They can provide guidance tailored to your specific case.

    7. Stay Persistent: Keep following up with both insurance companies. Sometimes persistence pays off, especially when dealing with claims.

Lastly, it’s strange that he would give you his information if he was truly denying the accident. Your documentation will be essential in showing that he may not be telling the truth. Good luck, and hopefully, it will get resolved soon!
